Supreme Court Ruling Sheds Light on the Importance of Reducing Risk
In a landmark May 14 ruling, the U.S. Supreme Court found that a man who was seriously injured when his parked tractor-trailer was struck by another semi can move ahead with a lawsuit against the third-party logistics company that brokered the load, according to Transport Topics. The court ruled in favor of Shawn Montgomery, who, in addition to suing Caribe Transport, sued C.H. Robinson, which brokered the load. Montgomery argued that C.H. Robinson should share liability because it hired the carrier. Dozens of states backed Montgomery’s claim, saying that allowing the suit to proceed would improve highway safety.
The Trump administration and Amazon, however, argued against exposing logistics companies to liability under numerous state laws, according to the May 14 Transport Topics article. “This is like asking travel agents to evaluate the safety of a given airline despite the fact that the airline has been licensed to fly by the federal government,” said Chris Burroughs, president and CEO of the Transportation Intermediaries Association. Justice Brett Kavanaugh, in a concurring statement, warned that the decision could increase insurance costs for freight brokers, leading to higher consumer prices.
